Voluntary compliance
Parties to an arbitration agreement undertake to comply voluntarily with the award. The award and applicable rules determine the timing. Identify precisely who must perform, in whose favour and what the tribunal has ordered.
Applying to a state court
Where compulsory enforcement is needed, the interested party applies to the competent state court for a writ of execution. The procedural route depends on the case and applicable procedural legislation.
The court examines the statutory grounds. This is a distinct stage; submitting an award does not automatically secure a writ. The agreement, tribunal formation, notice, arbitrability and public policy may be relevant.
After the writ is issued
The writ supports further compulsory execution under the law. An award, an enforceable instrument and actual recovery are different stages.
A foreign award follows the recognition and enforcement framework described in the next guide.
Institutions, ad hoc and foreign awards
Russian-seated institutional and ad hoc awards follow the writ procedure. Foreign-seated awards follow recognition and enforcement. See the three-model enforcement comparison and differences in court assistance with evidence.
From the award to a court application
Statutory basis: Articles 236–240 of the Commercial Procedure Code, Articles 423–427 of the Civil Procedure Code and Article 41 of 382-FZ. Following non-compliance within the applicable voluntary period, a creditor applies for a writ. The dispute and state-court jurisdiction determine the procedural code. An international arbitration seated in Russia does not produce a foreign award.
Identify the debtor and assets, court competence and venue, receipt date, unpaid amount and any parallel annulment case. Attach the award and agreement in the required form, translations where necessary, service evidence and the fee or exemption basis. Check the precise documents under Article 237 of the Commercial Procedure Code or Article 424 of the Civil Procedure Code.
What the court checks and what follows
Case law: Supreme Court 14 June 2017, 305-ES17-2111 upheld cassation’s correction of an impermissible merits reassessment and authorisation of enforcement. See the complete refusal grounds and supporting court practice. Disagreement with calculation or contract interpretation does not itself create an extra ground.
A writ and actual recovery are successive stages. Once the court order takes effect, obtain the execution document and present it through an authorised route, such as a bailiff or, subject to statutory conditions, a bank. Account for voluntary payments and avoid duplicate recovery of the same debt.
The filing period: identify its starting point
Case law: paragraph 62 of Plenum 53 gives both a writ application and foreign-award recognition application a period not exceeding three years from the award or the end of its stated voluntary-performance period. This is a court-filing period, distinct from the three-month annulment period and the period for presenting an issued writ for execution.
Restoration is not automatic: submit a reasoned application with evidence of a valid excuse and perform the omitted procedural act at the same time. Read Civil Procedure Code Article 409(3) and Article 112, or Commercial Procedure Code Article 246(2) and Article 117. For arbitral awards, apply the Plenum’s starting-point explanation rather than mechanically copying the finality rule for state-court judgments.
Russian awards: court and documents
Statutory basis: Commercial Procedure Code Article 236 and Civil Procedure Code Article 423. An economic matter within commercial-court jurisdiction goes to a regional commercial court; a general-jurisdiction matter goes to a district court. Normally apply where the debtor is based or resides, or where its property is located if that is unknown. A permitted party agreement may select the court of the award’s seat or creditor’s location. Assess subject matter and participants together.
The package under Article 237 / Article 424 includes the application identifying the award and requested writ, a copy of the signed award, the original agreement or certified copy, fee evidence and representative authority. The Commercial Procedure Code separately requires evidence of sending the application to the other party; the Civil Procedure Code requires its copy. State the unpaid amount accurately and retain receipt/performance evidence.
Foreign awards: separate venue and package
Statutory basis: Commercial Procedure Code Article 242, Civil Procedure Code Article 410 and Article 416, and paragraph 14 of Plenum 53. Economic matters go to the regional commercial court; general-jurisdiction matters go to a regional-level court, such as an oblast court or federal-city court, rather than a district court. Venue follows the debtor or, where the statute permits, its property.
Under Convention Article IV, Commercial Procedure Code Article 242(4) and Civil Procedure Code Article 416(2), provide the duly authenticated award and agreement or appropriate certified copies, with the required certified Russian translation. Address fees, authority and procedural attachments. Do not replace the arbitral-award package with the separate foreign-state-court judgment list in Article 242(3).
Partial performance and what the writ contains
Under paragraphs 52–53 of Supreme Court Plenum Resolution 53, a separable part of an award may remain effective and enforceable despite a defect elsewhere. Voluntary performance is not recovered a second time: the writ is refused for the performed part. The application and calculation should therefore show the award amount, each payment and the outstanding balance. Part-payment does not require refusal of the entire award.
The state court orders the issue of a writ rather than deciding the monetary claim again. The writ contains the enforceable operative part of the arbitral award under paragraph 59 of Plenum Resolution 53. The writ procedure also applies to determinations awarding and allocating costs and arbitration fees under paragraph 63; that does not make every interim tribunal act enforceable.
Real estate and legally significant registers
Under Law 382-FZ Article 43, an arbitral award alone does not authorise entries in a legally significant register without a competent court’s writ. Paragraph 56 of Plenum Resolution 53 specifically addresses cadastral records and registration of real-estate rights. A writ application is therefore available even for a declaration of title which does not require payment of money or delivery of an asset.
The need for state registration does not itself prohibit arbitration of a private-law dispute. Constitutional Court Judgment 46-P of 3 October 2023 requires substantive reasons for refusal. The specific dispute, third-party rights, arbitrability and public policy must be examined; registration procedure and arbitrability address different questions.
Succession, settlement and payment by instalments
After an award, the state court determines procedural succession, including at the enforcement stage, under Civil Procedure Code Article 44 or Commercial Procedure Code Article 48: paragraph 57 of Plenum Resolution 53. Assignment of a claim and substitution of the creditor in enforcement are separate matters; the assignment agreement does not itself alter the creditor named in an issued writ.
During writ proceedings, the parties may submit a settlement for state-court approval; the court checks legality and third-party rights under paragraph 58 of Plenum Resolution 53. This differs from an award on agreed terms issued by the arbitral tribunal during the arbitration.
Where the grounds in Civil Procedure Code Article 203 or Commercial Procedure Code Article 324 exist, the court issuing the writ may defer enforcement, allow instalments or alter the manner of execution on a party’s or bailiff’s application under paragraph 61 of Plenum Resolution 53. This requires a separate application and supporting circumstances; it is not another opportunity to retry the debt or contract.
Challenging the state court’s order
Orders in setting-aside or writ proceedings ordinarily go directly to cassation without an appeal stage under paragraph 60 of Plenum Resolution 53. Under Commercial Procedure Code Article 234(5) and Article 240(5), the circuit commercial court receives the complaint within one month from the order. Civil Procedure Code Article 422(5) and Article 427(5) invoke the civil cassation procedure: Article 376.1(1) ordinarily allows three months from the challenged order entering into legal force, unless the Code provides another period. The commercial Code’s special one-month period is not imported into a civil case.
The complaint concerns the legality of the state court’s order within the applicable cassation procedure. It is not an appeal against the arbitral award or a general retrial of the arbitral evidence. The three-month period for initially seeking annulment and the period for challenging the later court order are calculated separately.
