Armenia: the debtor’s property share after arbitration

Separation of a property share for execution, limitation and a two-judge dissent.

Case identification: after the award and writ

Armenian Court of Cassation, Civil Chamber, 2 June 2025, ED/50197/02/21. Armeconombank sought separation of the debtor’s share in jointly owned real estate, or sale and distribution of the proceeds if separation was impossible. This was a separate state-court action during recovery, not foreign-award recognition or an application to set aside an award.

Facts and lower-court approach

The Financial Arbitration of the Union of Banks of Armenia granted the monetary claim on 28 February 2017; on 1 November 2017 a state court authorised execution and issued a writ. In June 2018 the enforcement officer proposed an action to separate the debtor’s share. The bank filed on 29 October 2021. The first-instance judgment of 15 July 2022 and appellate decision of 10 March 2023 applied limitation and refused relief.

The cassation issue was whether this action newly protected a violated right, with its own limitation period, or served implementation of a claim already established. The creditor argued that the merits had been resolved and the property action merely overcame an enforcement obstacle arising from co-owners’ rights.

Majority reasoning, disposition and dissent

In section 4 the majority considered Civil Code Articles 200, 331 and 337 alongside the enforcement legislation. In these circumstances a share-separation action supports execution of a binding act rather than deciding the original dispute anew. The Court revisited its earlier 2008 approach and declined to treat the general limitation period as a bar to this claim.

Cassation allowed the complaint, quashed the appellate decision, itself rejected the limitation objection and remitted the case to first instance. It did not award the property share or complete a sale. A dissent by judges E. Sedrakyan and N. Hovsepyan follows the operative part: they disagreed with the majority’s reasoning and result. That disagreement matters to professional assessment even though the majority’s decision supplies the operative outcome.

Practical significance and boundaries

For the Armenia guide, the case explains the stage after permission to execute: an award does not eliminate third-party rights or the need for further court steps. It establishes neither the absence of every enforcement time limit nor guaranteed recovery from any property. The Court applied the framework identified in its decision; a new application requires separate consideration of enforcement reform, transitional provisions and the precise reason the previous enforcement proceedings ended.
