Case identification
Supreme Court Economic Chamber, case A60-36897/2020. Full text dated 9 December 2021; operative part announced 2 December. Relief: restraining PESA from SCC V2018/114 and a non-compliance sum under Article 248.2(10).
Facts and issue
A Russian company under personal restrictive measures sought to stop Stockholm arbitration. Lower courts found insufficient proof of impaired access. The Supreme Court considered both the sanctions standard and whether completed proceedings could be restrained.
Reasoning and location
The reasoning paragraphs beginning “По смыслу названной нормы…” and “Таким образом, из системного толкования…” establish a presumption of obstacles from personal sanctions. The concluding reasoning addresses the completed foreign proceedings. The act has no numbered paragraphs; these are textual locators.
Disposition
The Court quashed the orders of 24 November 2020 and 10 March 2021 but itself refused both restraint and monetary relief because no ongoing proceeding remained. This changed the reason for refusal; it did not grant the application.
