The award presented for enforcement
RoadServiceTrans sought recognition and enforcement in Moldova of a 31 July 2019 award made by the International Arbitration Court at the Belarusian Chamber of Commerce and Industry against Econstruct Group. The award concerned contractual debt, a penalty and costs. The Chișinău Court of Appeal granted the application on 30 July 2020. The debtor appealed to CSJ, asking it to quash the determination and remit the matter.
The objection raised
The court examined the appeal period separately: the state-court determination was emailed to counsel on 3 August 2020 and the appeal was lodged on 14 August. It was timely. Those dates concern the CSJ appeal, rather than proof of receipt of documents during the earlier arbitration.
The debtor alleged inadequate notice of the arbitrator’s appointment and of the proceedings themselves. It relied on hearing correspondence returned as unclaimed and said the award did not sufficiently record dispatch and receipt dates for the initiating claim. In its view, other means of communication should have been used. These were the debtor’s submissions, recorded at the beginning of the judgment, rather than judicial findings of a violation.
What CSJ found
On page 4, the court applied the refusal grounds in Code Article 476 and found that the notice rules had been followed on the facts examined. Contrary allegations were unproved; failure to claim dispatched mail was not attributed to the body that had properly arranged service. Enforcement was upheld in light of established compliance with service requirements, rather than merely because a postal label existed.
Applying this reasoning requires evidence of the address, prescribed communication method, dispatch of procedural documents and the party’s opportunity to participate. Notice of the arbitration, notice of tribunal constitution and receipt of the final award answer different procedural questions. See the guide to setting aside and refusal of enforcement for the connection between a particular defect and the right to present a case.
Disposition and scope
On 21 October 2020, CSJ dismissed the appeal and maintained recognition and enforcement. The Moldovan court neither annulled the Belarusian award nor re-decided the contract dispute. The legislation and treaty context discussed in the judgment concern the 2020 case; a new application requires a separate determination of the applicable statutory edition and treaty framework.
